In the Name of God Amen My Will

I Samuel Patton being of sound mind, but feeble in body, viewing the shortness and uncertainty of life, and being desirous to dispose of my Worldly affects without trouble to others, do make this my last Will and testament in the following way and manner (to wit)
I wish after my death to be decently buried and the expenses incident thereto be immediately and properly paid.

I desire my beloved wife Mary to remain in possession of all my lands, plantations, houses, stock of all kinds, plantation tools with all the appurtenances belonging to the farm, on or about the premises whereon I now reside, moreover I give and Bequeath to my aforesaid wife, Mary, the following negroes as her Bonafide right in Law, and Equity (to wit) Joe Bartho Clarke, Tom Winney Lumpkin Martha Little, Edey Big Edy, Andrew, Lewis, Amey, Miles, Little Joe, Nelson, Jane, Milley Mary, Elizabeth, Luzette, and Amanda – with their increase; I also give and Desire that my aforesaid wife should have all the Balances of my negroes, Lands & the personal property during her natural life with this priviso that my three children at home with me, to-wit - My Daughter Susan R I give the Girl Harriett which is to be taken from the negroes allowed to my wife aforesaid Wife Mary, during her lifetime; also I desire and give to my sons James T. and Benion their portion (Equal to the value of the above named girl Harriett) in money so as to be fully equal to the Balance of the childrens which is married and settled to be paid out of my Estate after my Death, and after the death of my aforesaid Wife Mary, all my property both real and personal to be equally divided among all my children, with the Exception of the first named Negroes, which my Dear wife has the right to do as she thinks best with. I more over desire and appoint my aforesaid Wife Mary my Executrix, and my Two sons, - Kinchen C and Benion Executors Jointly with their mother to manage my Estate and control my affairs in the most prudent manner. If in the judgement of my said Executors to sell a part of the personal property or make such other changes as they deem best I desire that they should do so.

Having a perposing full confidence in my Executors & Executrix, that they will manage and do justice to all concerned, so that satisfaction may be given to all, my children indiscriminately. In confirmation and testimony of which I here unto I set my hand and seal the October the 28th day A.D. 1847
