Virgil, along with brothers Burt and John Jr., built and operated the old Maxcy Grist Mill on Gum Creek in Itawamba County. Remnants of the Mill are still visible as of 2012.
Virgil's first marriage was to Eliza Harris on June 14, 1865 in Itawamba County, MS. The marriage was short-lived when Virgil discovered that Eliza was still married to Elijah Samples, and had not ended that marriage before becoming his wife. It was previously believed that Virgil's marriage to Eliza did not produce any children, and the divorce was finalized on Sept. 13, 1870. However, evidence has emerged indicating that he and Eliza did have a daughter: Ellen Melveta Maxey who married Joseph Martin Hicks in Fulton County, Arkansas in 1890. Silence in the family about the birth of Ellen leads to speculation about the circumstances of the birth, etc., and/or speculation about Virgil's desire for a son [and any excuse will do.]
